Jan. 28, 2010 Judgment Against Judge Alito
More information from the Boston Globe on Vanguard and Judge Samuel A. Alito who promised not to or swore to not impede justice when he took an oath. The 2002 case that alito voted in favor of Vanguard a company where he had $ 390,000.00 worth of mutual funds investment he did not recuse himself in the case.
That is a direct conflict of interest that the good judge Alito simply ignored and made certain that his investments were protected against any “frivolous lawsuits” as conservatives call it. You often here conservatives refer to that phrase when describing lawsuits against doctors which raise health care costs. The costs of incompetent doctors is not a direct cost of high health care costs but it is the cost of incompetency in our medical system. Conservatives seem to have a problem with phrases of corruption, break and entering Senator’s offices, and judges who are incompetent, self interested and just plain crooked.
The plaintiff in the case a woman named Shantee Maharaj who was involved in a case where her husband who had died had an individual retirement account at Vanguard who froze the account. Shantee took Vanguard to court to get back her husband’s assets which was a retirement account but the judge ruled in favor of her late husband’s business partner. After 10 years it ended up in the Supreme Court where Alito knowing full well he had investments in Vanguard took it upon himself to rule in the case and ruled against Maharaj and in favor of Vanguard.
Alito himself stated in a questionnaire that he would recuse himself but he did not which is an indication of Alito putting his financial interests above the law.
Quote from the Boston News:
Alito had been found to have anywhere between $ 390,000 to $975,000.00 in Vanguard investments which is almost 1 million dollars and he presided over the case. Obviously Alito also voted for more influence peddling in the political system and campaign contributions for which he should have recused himself.
